Exactly. The ACLU won't help this guy because they are concerned about individuals' rights, but rather because they want to wage war against law, order, and anything left of our civilization that's good. They aren't called the Association of Communist Lawyers United for nothing. :P Seriously, this guy is selfishly guarding his own rights, regardless of who else gets hurt. He didn't think about his siblings, the policeman or the employee, all of whom were just doing their jobs. His decision, how ever noble he tries to make it, is completely selfish.

I appreciate what Jay wrote; while I think that he can get semantical agreement, the guy should know better than to balk at something that simple. There are bigger fishes to fry; if he wants to challenge the culture, he should start elsewhere as just about every person in the entire planet knows the routine of checking receipts at stores that sell (relatively small and easy-to-steal) high-priced items. It's kind-of ridiculous, and I think that this is definitely right up the ACLU's alley. More power to them.
He might win, but he should pick on a little more significant fight if he feels like waging war on the government.

By the way, that "anonymous" comment was from my dad.

I emailed my lawyer aunt about this, (to get her opinion) and she said it sounded like a law school essay exam question. ;-)

Right on guys, (Nic did you post the second time?).

BTW, I just posted the article as is, I did not intend to nor recommend donating money :)

It just irks me that something like this can happen. Admittedly the guy was just being a sore to the store and police. However, if the store has a policy of voluntary searches, that is ok. If in practice, those "voluntary" searches become sudo mandatory we have a problem.

Okay, I am typing my comment a *second* time because the web engine threw away my first one when I didn't "answer the question." :{

Sarah's comment, and now Jay's, state my thoughts on the specifics. Let me make a general observation.

If you frustrate an LEO in what he is attempting to do, you will be arrested. If he is having a bad day, or you embarrass him or resist him in any physical way, you will be assaulted, possible shot, and then arrested. Only you can determine if the action (or inaction) you contemplate is worth the consequences, both short term and long term.

Personally I think Mr. Righi demonstrated a serious lack of judgment.

Ok... Wow, interesting.
Obviously the guy is a pain in the neck who instead of being a "law unto himself" feels like he has to push his limits to the extreme. Don't give the guy a cent.
No, the officer shouldn't have arrested him on the account that he did. He should have said, "Sir, you are currently suspected of thievery, if you do not provide proof that you did not burglarize, I will put you under arrest for stealing." (That way, he wouldn't have been "demanding" to see in the guy's bag (which would have not been legal)

And folks, in my county, it would be legal to put a (non-op.)50 caliber machine gun on the top of your SUV and stroll through the park with (unloaded) shotguns strapped to your chest, but do you do it just for the waist of time it will be when every single mother on the block summons the entire police force to swoop in for the inevitable firefight?? I don't think so.

"I don’t like the part about the ACLU involved…" -Nathan
Hey, that's what I said when we were discussing it. :-P

Here's my initial reaction. (i.e. subject to re-thinking)
Looking at it from the employee's and the policeman's side, this man was definitely acting suspiciously.
Stores should have the ability to inspect the bags/receipt of a customer. It would be too easy for people to shoplift if they know that the store can't catch them!
On the other hand, a policeman should not be able to arrest you for doing something legal... (in this case refusing to show a DL) Now, if he was arresting the man for not complying with the legal rights of the store employees, that would be a different story.
So... there's a lot of interesting facets to this case that could all be debated on their own merits, let alone when they're all put together! ;-)
